Terms of Service
These Terms of Service govern approved access to PulseIQ EMS Management, a Veltiq LLC product. They are effective as of August 28, 2026.
1. Agreement structure and eligibility
The agreement consists of these Terms of Service, an executed order form or pilot agreement, any applicable data-processing or business-associate agreement, and referenced policies. The agency representative signing an order form must have authority to bind the agency. If documents conflict, the negotiated order form controls, followed by any applicable data agreement, then these terms.
2. Access and permitted use
After commercial approval and secure provisioning, Veltiq LLC grants the customer a limited, non-exclusive, non-transferable right to use PulseIQ during the subscription term for the customer’s internal EMS administrative operations. Access is limited to authorized users, purchased modules, entitlements, and usage limits recorded in the customer’s order form and canonical subscription.
3. Customer accounts and responsibilities
The customer is responsible for accurate account information, selecting authorized administrators, maintaining appropriate user roles, promptly disabling access that is no longer required, protecting authentication factors, and reporting suspected unauthorized access. The customer must ensure that its instructions, uploaded content, and use of PulseIQ comply with applicable law, employment obligations, records requirements, and agency policy.
4. Prohibited conduct
Users may not attempt to bypass tenant isolation, permissions, subscription or activation gates; access another customer’s data; probe or disrupt the service; introduce malicious code; reverse engineer except where law expressly permits; use the service for unlawful surveillance or discrimination; or submit content they are not authorized to process.
5. PHI and regulated data hold
PHI is prohibited unless and until Veltiq LLC provides express written authorization for a specific customer environment. Any future authorization must follow counsel’s written determination, an executed BAA where required, approved subprocessors, required vendor compliance add-ons and configuration, and documented operational safeguards. Until then, customers must not enter patient names, medical record numbers, incident narratives that identify a patient, or other PHI. PulseIQ is an administrative management tool and does not provide medical advice or replace clinical judgment, an ePCR, CAD, or required system of record.
6. Customer data and privacy
As between the parties, the customer retains its rights in customer data. The customer authorizes Veltiq LLC and approved subprocessors to process that data only to provide, secure, support, and improve the contracted service and meet legal obligations. Processing details, deletion procedures, security responsibilities, and any regulated-data terms are governed by the applicable agreement and privacy documents.
7. Fees, taxes, and billing
Fees, billing cycle, service limits, renewal terms, taxes, payment method, and any complimentary pilot period must appear in an executed order form. A zero-dollar pilot still uses the canonical contract, subscription, entitlement, provisioning, and activation gates. The public evaluation form does not authorize a charge. Payment-provider terms must be approved and tested before automated charging is enabled.
8. Support, availability, and changes
Support hours, severity definitions, first-response targets, maintenance notices, service credits, and any availability commitment apply only as stated in the executed order form or approved support policy. Veltiq LLC may change the service to improve security, reliability, or functionality, subject to any notice obligations in the agreement.
9. Confidentiality
Each party must protect the other party’s non-public business, technical, security, and customer information using reasonable safeguards and use it only to perform the agreement. Confidential information does not include information that is public through no breach, independently developed without use of confidential information, lawfully received without restriction, or legally required to be disclosed.
10. Intellectual property and feedback
Veltiq LLC and its licensors retain ownership of PulseIQ, its software, designs, documentation, and related intellectual property. The customer receives only the access rights expressly granted. No additional feedback license, right to use customer marks, or right to use aggregated or de-identified service information is granted by these Terms.
11. Suspension, term, termination, and export
Term and renewal, cure rights, suspension for security or material breach, termination rights, data export timing, retention, deletion, and legally required preservation are governed by the executed order form and applicable agreements. Access must not be manually activated or retained outside the canonical commercial lifecycle.
12. Warranties, disclaimers, liability, and indemnity
This publication does not state additional warranty, disclaimer, limitation-of-liability, exclusion, indemnity, insurance, equitable-relief, or risk-allocation provisions. Any such provisions apply only when stated in an executed order form or other applicable agreement.
13. Governing law and general terms
Governing law, venue, dispute procedure, assignment, force majeure, notices, severability, waiver, export controls, government-use language, and any amendment process apply only as stated in an executed order form or other applicable agreement.
